Terms of Service
These Terms of Service govern your use of WanderBees and constitute a legally binding agreement between you and WanderBees under Nepal law. By accessing or using WanderBees you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, do not use the platform.

1. The Parties and Governing Law
These Terms of Service ("Terms") are entered into between: Service Provider: WanderBees (operated by Subas Gautam / WanderBees Pvt. Ltd.), a company registered in Nepal under the Company Act 2063 (2006), with a registered office in Kathmandu, Nepal. User: Any individual who accesses, browses, registers on, or otherwise uses the WanderBees website or platform. These Terms are governed by and construed in accordance with the laws of Nepal, including but not limited to: • E-Commerce Act 2081 (2025) — the primary statute governing digital service agreements • Muluki Civil Code 2074 (National Civil Code) — governing contract formation and validity • Consumer Protection Act 2075 (2018) • Individual Privacy Act 2075 (2018) • Electronic Transactions Act 2063 (2006) • Tourism Act 2035 (1978) and related regulations • Copyright Act 2059 (2002) Acceptance: Your use of WanderBees constitutes your acceptance of these Terms. Clicking "I Agree", "Create Account", or any equivalent button or checkbox constitutes valid acceptance of a click-wrap agreement under Section 7 of the E-Commerce Act 2081 and has the same legal effect as a written signature.
2. Eligibility and Account Registration
Age Requirement: You must be at least 18 years of age to use WanderBees and create an account. Under the Muluki Civil Code 2074 (National Civil Code of Nepal), persons under 18 lack the legal capacity to enter into binding contracts. If you are under 18, you may use the platform only under the supervision of a parent or legal guardian who accepts these Terms on your behalf. Account Accuracy: You agree to provide accurate, current, and complete information when registering an account. You are responsible for maintaining the accuracy of your account information and must update it within 48 hours of any change, consistent with the E-Commerce Act 2081. Account Security: You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised use of your account. One Account Per Person: You may not create multiple accounts or create an account on behalf of another person without their knowledge and consent. We reserve the right to suspend or terminate accounts that contain false information, are used in violation of these Terms, or are involved in abusive or fraudulent activity.
3. Nature of the WanderBees Service
WanderBees is a travel and adventure activity discovery platform. It provides: • Information about outdoor activities, destinations, city hubs, and travel bundles in Nepal • Route logistics, distance, difficulty ratings, seasonal guidance, cost estimates, and permit information • Community condition reports and safety signals submitted by users • Weather and advisory signals for destination planning • Bookmarking and personal journey planning tools WanderBees is a discovery and information platform — not a travel agency, booking agent, or tour operator. We do not, in the ordinary course of our service, book tours, process payments for third-party operators, arrange guides, or issue permits. Where we facilitate connections with third-party operators, additional terms specific to those transactions will be presented. Under the Tourism Act 2035 (1978), a "Travel Agency" or "Trekking Agency" is defined as a business that arranges or facilitates travel for commercial gain. WanderBees provides discovery and informational services; if we expand into direct bookings or commercial facilitation, we will obtain the appropriate tourism license from the Department of Tourism as required by that Act. Accuracy of Information: We make reasonable efforts to ensure the accuracy of the information displayed on WanderBees. However, route conditions, permit fees, operator availability, weather, costs, and travel times change frequently. All information on WanderBees is provided as a planning input, not a guarantee of current conditions. Always verify critical information — permits, access, guides, operator status — directly with the relevant authorities or operators before departure.
4. Adventure Activity Safety Disclaimer
Outdoor and adventure activities carry inherent risks including serious injury and death. WanderBees provides planning information to help you prepare, but the ultimate responsibility for your safety rests with you. Before undertaking any activity featured on WanderBees, you must: 1. Verify current conditions — trail conditions, river levels, weather, access routes, and seasonal closures can change without notice. Use the WanderBees community reports as a starting point, but verify with local authorities, guides, and operators. 2. Obtain required permits — many trekking routes, national parks, and restricted areas in Nepal require permits. As of 2025–2026, foreign trekkers are required to hire a licensed guide for regulated routes (mandatory guide requirement, Nepal Department of Tourism, 2025). Relevant permits include: • TIMS Card (Trekkers' Information Management System) — approximately NPR 600 (nationals) / USD 17 (foreigners) • National Park entry permits — Sagarmatha, Annapurna, Langtang, and others • Restricted Area Permits (RAP) — Upper Mustang, Manaslu, Nar Phu Valley, and others Permit requirements, fees, and procedures are subject to change by the Government of Nepal. WanderBees displays permit information in good faith but is not responsible for legislative changes. 3. Hire certified guides and porters where required — Nepal requires licensed guides certified by the Nepal Academy of Tourism and Hotel Management (NATHM) or Nepal Mountaineering Association (NMA) for designated regulated routes. 4. Assess your own fitness and skill — difficulty ratings on WanderBees are general indicators. You are responsible for determining whether an activity is within your physical capabilities and experience level. 5. Carry appropriate equipment and insurance — mountain rescue, emergency evacuation, and medical treatment in Nepal are the responsibility of the traveller. We strongly recommend comprehensive travel and rescue insurance. WanderBees accepts no liability for personal injury, death, loss of property, or any other harm arising from participation in activities described on the platform.
5. User-Generated Content
WanderBees allows users to submit condition reports, safety observations, and other community content ("User Content"). Your Ownership: You retain full copyright ownership of the original User Content you submit, in accordance with the Copyright Act 2059 (2002) of Nepal. License Grant to WanderBees: By submitting User Content, you grant WanderBees a non-exclusive, royalty-free, worldwide, transferable license to display, distribute, reproduce, adapt, and make available your User Content as part of the WanderBees service. This license continues for as long as your content remains on the platform and terminates when you delete it or close your account. Your Content Standards: You agree that User Content you submit will: • Be accurate to the best of your knowledge • Not be defamatory, abusive, obscene, threatening, or discriminatory • Not infringe any third party's copyright, trademark, or other intellectual property rights • Not contain personal data of other individuals without their consent • Comply with the Electronic Transactions Act 2063 (2006), in particular Section 47, which prohibits the publication of illegal, immoral, or defamatory material in electronic form Platform Liability: As the platform hosting User Content, WanderBees may face secondary liability under Section 47 of the Electronic Transactions Act 2063 for knowingly hosting illegal content. We reserve the right — but are not legally obligated — to moderate, edit, or remove User Content at our discretion. We will remove content upon receiving a credible complaint. No Safe Harbour: Nepal does not currently have a statutory notice-and-takedown safe harbour regime equivalent to the DMCA. WanderBees operates a voluntary takedown policy: any person who believes User Content infringes their rights may contact us at [email protected].
6. Intellectual Property
WanderBees Platform: The WanderBees name, logo, website design, source code, database, activity listings compiled by WanderBees, and all original editorial content are protected by the Copyright Act 2059 (2002) of Nepal and applicable intellectual property laws. The "WanderBees" name and bee logo are proprietary marks of WanderBees. You may not use them without our prior written consent. We have filed or intend to file a trademark application with Nepal's Department of Industry under the Patent, Design and Trade Mark Act 2022 (1965). Permitted Use: You may view, bookmark, and share links to WanderBees content for personal, non-commercial use. You may not: • Copy, scrape, or reproduce WanderBees content, database listings, or compiled activity data for commercial purposes • Frame or embed the WanderBees website in another platform without our written consent • Reverse-engineer, decompile, or extract source code from the WanderBees platform • Use automated bots, scrapers, or crawlers to collect data from WanderBees beyond standard search engine indexing Third-Party Content: Some images, maps, or data displayed on WanderBees are licensed from third parties. These remain the property of their respective owners and are used under license.
7. Prohibited Uses
You agree not to use WanderBees for any of the following: Legal violations • Any activity that violates Nepal law, including the Electronic Transactions Act 2063, the E-Commerce Act 2081, the Consumer Protection Act 2075, or any applicable regulation • Hacking, unauthorised access, or interference with WanderBees systems (Section 45, Electronic Transactions Act 2063) • Transmitting malware, ransomware, or any destructive code (Section 46, Electronic Transactions Act 2063) • Publishing defamatory, obscene, threatening, or illegal content (Section 47, Electronic Transactions Act 2063) • Identity fraud or impersonation (Information Technology and Cyber Security Act 2082) Misuse of the platform • Creating false or misleading condition reports that could endanger other travellers • Using the platform to promote unlicensed guide services, illegal operators, or activities in prohibited areas • Attempting to circumvent account security, access controls, or payment mechanisms • Collecting other users' personal data from the platform • Commercially exploiting WanderBees content or data without a written licence agreement Consequences: Violations may result in immediate account suspension, permanent banning, referral to the Nepal Police Cyber Bureau, and civil or criminal proceedings under applicable Nepal law.
8. Third-Party Operators and Bookings
WanderBees may display information about, or provide links to, third-party tour operators, trekking agencies, rafting companies, and adventure sports providers ("Third-Party Operators"). Relationship: WanderBees is not a party to any agreement between you and a Third-Party Operator. We do not endorse, verify the licences of, or guarantee the services of Third-Party Operators displayed on our platform. Licensing: Under the Tourism Act 2035 and relevant regulations, trekking agencies, adventure sports operators, and travel companies operating in Nepal are required to hold valid tourism licences from the Department of Tourism. We recommend verifying the licence status of any operator before booking. Liability: WanderBees accepts no liability for the acts, omissions, failures, negligence, or defaults of Third-Party Operators. Disputes arising from bookings or services provided by Third-Party Operators are matters between you and that operator. Where WanderBees facilitates an actual booking or payment transaction for a Third-Party Operator, we bear liability for complaints related to the facilitation of that transaction under Section 15 of the E-Commerce Act 2081.
9. Consumer Rights and Grievance Redressal
Your Rights Under Nepal Law Under the Consumer Protection Act 2075 (2018) and E-Commerce Act 2081 (2025), you have the right to: • Accurate information about our services • A functional grievance mechanism • Resolution of complaints within 15 days of submission • Protection from misleading advertising, hidden fees, and unfair trade practices Refunds and Cancellations Where WanderBees processes a payment on your behalf (for premium services or facilitated bookings): • Refund terms applicable to that specific service will be disclosed before payment • Statutory consumer protection rights under the Consumer Protection Act 2075 apply and cannot be waived Filing a Complaint To file a complaint: 1. Contact us at [email protected] or through thewanderbees.com/contact 2. We will acknowledge your complaint immediately and resolve it within 15 days 3. If you are not satisfied with our resolution, you may escalate to: • Consumer Court (established under the Consumer Protection Act 2075), Tripureswor, Kathmandu, or the relevant provincial equivalent • Department of Commerce, Supplies and Consumer Protection under the E-Commerce Act 2081 • Nepal's IT Tribunal for disputes arising under the Electronic Transactions Act 2063
10. Limitation of Liability
To the fullest extent permitted by the laws of Nepal, WanderBees' liability to you is limited as follows: Information Accuracy: WanderBees provides activity, destination, route, cost, and permit information as a planning aid. We make no warranty — express or implied — that this information is current, complete, or accurate. We are not liable for loss, injury, or harm arising from reliance on information displayed on the platform. Platform Availability: We do not guarantee uninterrupted or error-free access to WanderBees. We are not liable for losses caused by temporary unavailability, technical failures, or third-party service outages. User Content: We are not liable for the accuracy or reliability of condition reports or other User Content submitted by other users. Maximum Liability Cap: Where liability cannot be excluded, our total aggregate liability to you arising out of or in connection with these Terms shall not exceed the amount you paid to WanderBees for the specific service that gave rise to the claim in the 12 months preceding the claim, or NPR 10,000, whichever is greater. Consumer Protections Are Not Waived: Nothing in this section limits or excludes any rights you have as a consumer under the Consumer Protection Act 2075 (2018), the E-Commerce Act 2081 (2025), or any other mandatory provision of Nepal law that cannot be excluded by contract.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Nepal. Any dispute arising out of or in connection with these Terms that cannot be resolved informally shall be subject to the jurisdiction of the courts of Nepal. Applicable courts and forums by subject matter: • Consumer disputes: Consumer Court under the Consumer Protection Act 2075, or the District Court with jurisdiction • Electronic/digital service disputes: Nepal's IT Tribunal under Sections 60–65 of the Electronic Transactions Act 2063 • General contract disputes: District Court with territorial jurisdiction over Kathmandu, Nepal • Appeals: High Court, then Supreme Court of Nepal Informal Resolution First: Before initiating any formal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at [email protected] and allowing us 30 days to respond. Governing law clauses designating foreign jurisdictions are not enforceable against Nepali consumers under Nepal law. These Terms and any disputes arising from them are governed exclusively by Nepal law.
12. Termination and Suspension
We may suspend or terminate your account and access to WanderBees at any time, with or without notice, for: • Violation of these Terms • Conduct that endangers the safety or wellbeing of other users or the community • Repeated submission of false or harmful condition reports • Abusive, threatening, or harassing behaviour toward WanderBees staff or other users • Where required by law or court order You may close your account at any time by contacting us at [email protected]. Upon closure, your personal data will be handled in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — shall survive termination.
13. Changes to These Terms
We may update these Terms to reflect changes in our services, Nepal law, or regulatory requirements. For material changes: • We will update the "Last Updated" date at the top of this page • We will notify registered users by email at least 14 days before material changes take effect • Continued use of WanderBees after the effective date constitutes acceptance of the revised Terms • If you do not agree with a material change, you may close your account before it takes effect Non-material changes (such as clarifications, typographic corrections, or updates to contact details) may be made without advance notice.
